Welcome to COREA Starstroupe (“we,” “us,” or “our”), a non-profit organization based in Cebu City, Philippines, dedicated to advancing open-source artificial intelligence research and innovation. By accessing or using our website, including our research paper archive and related resources (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our Services.

These Terms govern your use of our Services and outline your responsibilities, our rights, and the legal framework for our relationship. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Services, you confirm that you are at least 18 years old or have the legal capacity to enter into a binding agreement under the laws of the Philippines. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may update these Terms from time to time. Changes will be effective upon posting the revised Terms on our website, and we will update the “Last Updated” date above. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

2. Description of Services

COREA Starstroupe provides a platform for accessing open-source research papers, documentation, and resources related to natural language processing, embedded AI, and human-computer interaction. Our Services include, but are not limited to:

• The COREA Starstroupe Research Paper Archive, a searchable collection of academic papers.
• Publicly available documentation and technical resources for projects such as Nexora, Peachi OS, Auralis, and others.
• Community engagement tools, such as forums or contact forms, if available.

Our Services are provided free of charge, consistent with our non-profit mission to promote open access to AI research.

3. User Responsibilities

3.1 General Conduct

You agree to use the Services in a lawful, ethical, and respectful manner. You must not:

• Engage in unauthorized access to or use of our systems, networks, or data.
• Distribute malware, viruses, or other harmful code.
• Use the Services to engage in illegal activities, including but not limited to copyright infringement, fraud, or harassment under Philippine law.
• Interfere with the operation of the Services, such as through denial-of-service attacks or excessive automated requests.
• Misrepresent your identity or affiliation when using the Services.

3.2 Content Usage

Our research papers and resources are provided under open-source licenses, as specified in each document (e.g., Creative Commons or MIT License). You agree to:

• Respect the terms of the applicable licenses when using, modifying, or distributing our content.
• Provide appropriate attribution to COREA Starstroupe and the original authors when required.
• Not use our content for commercial purposes unless explicitly permitted by the license.

3.3 User Contributions

If you submit feedback, suggestions, or other content to us (e.g., via contact forms or community forums), you grant COREA Starstroupe a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, and distribute such content for our non-profit mission. You represent that you have the right to provide such content and that it does not violate any third-party rights.

4. Intellectual Property

4.1 Ownership

Unless otherwise specified, all content available through the Services, including research papers, logos, and website design, is owned by COREA Starstroupe or its licensors. Our content is protected by copyright, trademark, and other intellectual property laws of the Philippines and applicable international treaties.

Logos associated with specific projects (e.g., Nexora.png, Corea OS.png, Auralis.png, Credits.png) are trademarks of COREA Starstroupe and may not be used without permission, except as necessary to reference our work in accordance with applicable licenses.

4.2 Open-Source Licenses

Most of our research papers and technical resources are released under open-source licenses. You may use these materials in accordance with the terms of the specific license attached to each resource. Where no license is specified, content is provided for non-commercial, educational, and research purposes only, with all rights reserved.

4.3 Third-Party Content

Our Services may include links to third-party websites or resources. We do not endorse or control such content, and your use of third-party resources is subject to their respective terms and policies.

5. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use the Services, in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines. By using the Services, you consent to our data practices as described in the Privacy Policy.

We may collect non-personal usage data (e.g., page views, search queries) to improve our Services. Such data is anonymized and used solely for analytical purposes.

6. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. COREA Starstroupe does not guarantee that:

Use of the Services is at your own risk. We are not responsible for any loss or damage resulting from your reliance on our content or Services.

7. Limitation of Liability

To the fullest extent permitted by Philippine law, COREA Starstroupe, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, including but not limited to:

• Loss of data, profits, or opportunities.
• Damages caused by errors, omissions, or inaccuracies in our content.

9. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, with or without notice, if you violate these Terms or engage in conduct that we deem harmful to our mission or community. Upon termination, your right to use the Services will cease, but any provisions of these Terms that by their nature should survive (e.g., intellectual property, liability) will remain in effect.

You may stop using the Services at any time. No account registration is required to access our public resources.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.

10.2 Dispute Resolution

In the event of a dispute arising from or related to these Terms or the Services, you agree to first attempt to resolve the issue informally by contacting us at contact@coreastarstroupe.org. If the dispute is not resolved within 30 days, either party may pursue resolution through binding arbitration, except for claims that may be brought in a court of competent jurisdiction in Cebu City.

Arbitration will be conducted in Cebu City, Philippines, under the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). The arbitrator’s decision will be final and binding, and judgment may be entered in any court of competent jurisdiction. Each party will bear its own costs, except as otherwise provided by law.

You waive any right to participate in a class action or consolidated proceeding against COREA Starstroupe.

11. Accessibility

We are committed to making our Services accessible to all users, including those with disabilities. If you encounter any accessibility issues, please contact us at accessibility@coreastarstroupe.org, and we will work to address them promptly.

12. Force Majeure

COREA Starstroupe will not be liable for any failure to perform its obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, wars, pandemics, power outages, or cyberattacks.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and COREA Starstroupe regarding the use of the Services, superseding any prior agreements.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction, provided it does not adversely affect your rights.
